1. About this policy
Track Now Proprietary Limited (ABN 12 634 559 970) ("TrackNow", "we", "us", "our") provides GPS tracking, fleet management and telematics products and services to businesses across Australia. We are committed to protecting personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
This policy explains what information we collect, how we use it, who we share it with, and how you can access it, correct it or make a complaint. It applies to our website (www.tracknow.com.au), our customer portal, our tracking hardware and our related services.
2. What we collect
The information we collect depends on how you interact with us.
- Contact and business details. Name, company, position, email address, phone number and business address, collected when you request a demo or quote, contact support, apply to our reseller program or otherwise deal with us.
- Account information. Login details, user roles and activity records for users of the TrackNow portal.
- Billing information. Billing contacts, invoicing details and payment records. Card payments are processed by our payment providers. We do not store full card numbers on our systems.
- Telematics and tracking data. Our devices and platform collect vehicle and asset data including GPS location, trip history, speed, ignition status, driver behaviour events (such as harsh braking or acceleration), engine diagnostics and, where a dashcam is fitted, video and audio footage.
- Website data. Standard website logs and analytics such as IP address, browser type, pages visited and referring pages, collected through cookies and similar technologies.
3. Telematics data collected through your employer
If you drive a vehicle fitted with a TrackNow device, your employer or the fleet operator is usually our customer. They decide what is tracked, who can see the data and how long it is kept, and we process that data on their behalf to deliver the service.
Fleet operators are responsible for notifying their drivers about vehicle tracking and monitoring, and for complying with any workplace surveillance and employee monitoring laws that apply in their state or territory. If you have questions about tracking data in a vehicle you drive for work, please speak with your employer first. We will refer any request we receive from a driver to the relevant fleet operator unless the law requires otherwise.
4. How we use information
We collect, hold and use information to:
- provide and support our tracking, fleet management and compliance services;
- set up and administer customer accounts, portals and hardware installations;
- process orders, invoices and payments;
- respond to enquiries and provide customer and technical support;
- produce reports our customers use for safety, maintenance, fatigue and compliance purposes (including under the Heavy Vehicle National Law and Chain of Responsibility obligations);
- improve our products, website and services;
- send service updates and, where permitted, marketing about our products (you can opt out at any time); and
- meet our legal and regulatory obligations.
5. Who we share information with
We do not sell personal information. We may share information with:
- our service providers, such as cloud hosting, mapping, telecommunications, email and SMS providers, and payment processors;
- hardware suppliers and accredited installers, to the extent needed to supply and install devices;
- our resellers and partners, where they manage your account with your knowledge;
- professional advisers such as lawyers, accountants and insurers; and
- government agencies, courts, police or regulators where we are required or authorised by law to do so, for example in response to a warrant or other lawful request.
6. Storage, security and overseas disclosure
We store information on secure cloud infrastructure. Some of our hosting and software providers may store or process data on servers located outside Australia, including in the United States. Where that happens, we take reasonable steps to ensure the information is handled consistently with the Australian Privacy Principles.
We protect information using measures appropriate to its sensitivity, including encryption of data in transit, access controls, role-based permissions in our portal, and monitoring. No system is completely secure, but we work to protect information from misuse, interference, loss and unauthorised access, modification or disclosure.
7. How long we keep information
We keep personal information for as long as it is needed to provide our services, meet contractual commitments to our customers, and satisfy legal, accounting and reporting requirements. Telematics data is retained in line with our agreements with each fleet operator. When information is no longer required, we take reasonable steps to delete or de-identify it.
8. Cookies and analytics
Our website uses cookies and similar technologies to keep the site working properly and to understand how visitors use it. You can control or block cookies through your browser settings. Blocking cookies may affect how parts of the site work.
9. Access and correction
You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. Contact us using the details below. We will respond within a reasonable time. If we refuse a request, we will explain why in writing.
